JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 342, 323, 324, 325, 307 and 504 of the Indian Penal Code. The prosecution case is that an altercation took place between the daughters of the petitioner and the informant when petitioner and five others assaulted the informant and abused by calling caste name. It is specifically alleged that co-accused Harendra Ram caused injury on the head of the informant with 'axe', as a result the informant fell down, when brother of the informant came to rescue he was also assaulted by the accused persons.
It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. The informant
Patna High Court Cr.Misc. No.57093 of 2015 (2) dt.18-12-2015 2/2 has received superficial simple injury whereas the injury report of the brother of the informant shows pain and superficial swelling(Lt) elbow joint, which has been found to be simple in nature.
Considering the genesis of the occurrence and nature of injury caused coupled with a statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Bagaha, West Champaran in connection with Valmikinagar P.S. Case No.46/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
