The petitioners seek bail in Excise Case No. 556/2019, arising out of Jehanabad P.S. Case No. 381/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that two mobile sets, Rs. 7,000/- cash and 50 bottles, each containing 500ml of Beer have been recovered from possession of petitioner no. 1. It is further alleged that two mobile sets, 43 bottles, each containing 500ml of Beer and 3 bottles, each containing 750ml of foreign liquor have been recovered from possession of

It is mentioned in para 3 of bail petition that one other case of Excise Act is pending against petitioners. Petitioners are in custody since 22.05.2019.

Keeping in view the period of custody spent by petitioners, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ IInd, Jehanabad, in connection with Excise Case No. 556/2019, arising out of Jehanabad P.S. Case No. 381/2019, subject to the conditions that both the bailors shall be the close relative of the petitioners.

The petitioners will file affidavit at the time of filing bail bond that they would not indulge in such type of activity in future. In the event, they are found indulged in such type of activity, their bail bond in the instant case will liable to be cancelled.
