2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 354, 504 of the Indian Penal Code.
3. According to F.I.R., this petitioner is alleged to have assaulted the wife of the informant on her hand with lathi.
4. It is submitted that petitioner has falsely been implicated in this case due to village politics. As a matter of fact, the petitioner did not vote for the wife of the informant in the ward election and in retaliation this false and concocted case has been lodged against him. It is further submitted that as per the F.I.R., petitioner is alleged to have assaulted on the hand of the wife of the informant with lathi whereas, during course of investigation, the injured wife of the informant has not
Patna High Court CR. MISC. No.45255 of 2023(4) dt.21-09-2023 2/2 supported the prosecution case and she has categorically stated that it was one Karu Chauhan who assaulted her on the hand. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Narhat P. S. Case No. 103 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
