The petitioner is a lady and has filed the present writ application for a direction upon the police authorities not to harass her husband or any relative(s) of her husband. Such prayer was made with reference to Muzaffarpur P.S. Case No. 131 of 2012 registered under Section 366, 366(A) of the I.P.C. On her own
Patna High Court CWJC No.3869 of 2014 (2) dt.27-09-2016 2/2 volition, she claims to have married with Md. Nasibur Rahman. The father of the petitioner, however, lodged the aforesaid case. In these factual backgrounds, the writ petition is filed. The counsel for the State has drawn attention of the Court to the statements made in the counter affidavit filed on behalf of the respondent-Superintendent of Police. In paragraph 9 thereof, the history of the case has been noted and it's stated that having investigated the police found the case not substantiated and a final form (Annexure-A) has been filed. On these facts stated in the counter affidavit, it has been submitted that the application has become infructuous as the relief was prayed against the police authority in relation to the aforesaid criminal case lodged by her father. The court is in agreement with the submission of the State counsel.
The application is dismissed as having become infructuous.
