JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Simri Police Station Case No. 105 of 2016 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Petitioner was Panchayat Secretary and the allegation against him is that he did not submit folders and relevant documents of appointment of Panchayat teachers of various Panchayats but submission on behalf of the petitioner is that, as a matter of fact, he joined in concerned Panchayat on 03.08.2013 and at the time of his joining, his predecessor had not given charge of folders and relevant documents relating to appointment
Patna High Court Cr.Misc. No.45063 of 2016 (2) dt.19-12-2016 2/2 of Panchayat teachers of the Year 2003, 2005 and 2006 and the petitioner had already informed to the concerned authorities regarding the aforesaid fact and, moreover, petitioner has already submitted relevant documents to the concerned authorities of the year 2008, 2011 and 2012.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Simri Police Station Case no. 105 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
