JUSTICE BIRENDRA KUMAR ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. Two persons were killed for previous enmity. The petitioner is not named in the First Information Report. His name has transpired in the confessional statement of co-accused, namely, Govind Kumar wherein Govind Kumar has stated that the petitioner was conspirator and at the instance of the petitioner the crime, alleged, was committed.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.47991 of 2016 (4) dt.27-01-2017 2/2 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court in connection with Saraiya Police Station Case No. 134 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
