The petitioner seeks bail in Samastipur (Rail) P.S. Case No. 143/2018, instituted for offences under Sections 20 and 22 of NDPS Act.
It is alleged in the written report that on secret information the police party reached at platform no. 7 of Samastipur Railway Station and apprehended the petitioner from Awadh Assam Express along with trolly bag containing 9.5kgs of Ganja. On query, petitioner disclosed that aforesaid Ganja belongs to one Harikesh Yadav of village Tamkuhi (U.P.) and has to deliver the same to one Rajeev Kumar of Sulabh Sauchalaya situated at bus stand Gopalganj, who would pay him
Patna High Court Cr.Misc. No.66054 of 2018(3) dt.03-12-2018 2/2 Rs. 2,000/- for the same.
As such, petitioner was knowingly carrying the aforesaid Ganja.
In view of such, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.
The trial court is directed to expedite the trial and make all efforts to dispose off the same as early as possible preferably within a period of six months from the date of receipt of this order.
