Heard the counsel for the petitioner.

No one appeared on behalf of the State.

The petitioner herein seeks anticipatory bail in Alamnagar P.S. Case No. 106 of 2015 registered under Sections 147, 149, 341, 323, 325, 354(A), 504, 506, 380, 307 of the Indian Penal Code.

Both sides are gotiyas. In relation to the incident which took place on the relevant date, there is a case and counter case (Annexure-3) lodged by wife of the petitioner, in which the present set of prosecution party are accuseds. In the FIR, it is alleged that the accused persons came at the door of the

No.54024 of 2015 (3) dt.02-03-2016 2/2 informant and started to abuse and when he made protest they assaulted him with iron rod and when his son Rajeev Kumar rushed for his rescue the petitioner caught hold of him and another co-accused assaulted on his neck with the butt of pistol causing injury simple in nature.

The counsel for the petitioner states that in the counter case also several persons received injury at the hands of the present prosecution party. The petitioner has no criminal antecedent.

In the facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned S.D.J.M.

Uda-Kishunganj (Madhepura) in Alamnagar P.S. Case No. 106 of 2015 on condition that one of the bailors shall be his own/close family member. The petitioner shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
