JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2017 The petitioner is apprehending his arrest in connection with Gandhi Maidan P.S. Case No. 227 of 2016, registered for offences punishable under Sections 3/4/5 of the Immoral Traffic (Prevention) Act, 1956.

It has been submitted on behalf of the petitioner that except that the petitioner is owner of the Hotel, there is nothing against him and whatever the allegation has been made, is against his staff.

Heard learned Additional Public Prosecutor also. Having heard both sides. There is nothing against the petitioner except that he is owner of the Hotel. Considering the aforesaid facts, let the petitioner, Md. Azad Alam surrender before the court below on 7th February 2017

Patna High Court Cr.Misc. No.45180 of 2016 (3) dt.30-01-2017 2/2 and the court below will release the petitioner on furnishing bail bonds of Rs. 50,000 (Rs. Fifty Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 227 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

It is further subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and the petitioner will cooperate with the Police during investigation of the case and make himself available before the police as and when required.

It is also made clear that once the charge sheet is submitted in this case, the petitioner will surrender before the court below and make prayer for regular bail and the court below will pass an appropriate order on the basis of material available in the case diary.

With the above observation/direction, this petition is disposed of.
