JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-03-2021 Heard Mr. Ravish Mishra, learned Counsel for the petitioner and Mr. Nawal Kishore Prasad, learned Additional Public Prosecutor for the State, through Video Conferencing. This application, for grant of regular bail, arises out of Khushrupur Police Station Case No. 242 of 2019, disclosing offences under Sections 341/323/379/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is that the petitioner said to have fired upon the informant. Learned counsel for the petitioner submits that there was quarrel between the petitioner and cousin brother of the informant on the issue relating to dispute of passage. Learned counsel next referring to Annexure-2 submits that the injury caused to the informant has been found to be simple in

Patna High Court CR. MISC. No.4079 of 2021(2) dt.24-03-2021 2/2 nature. Learned counsel next submits that petitioner is in custody since 17.09.2020, i.e., more than six months. Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that both the parties are co-villagers and injury caused to the informant is simple in nature, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Ajay Singh, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna City, Patna, in connection with Khushrupur Police Station Case No. 242 of 2019.

It is made clear at the time of furnishing bail bond, all the parties shall follow the guidelines regarding social distancing.
