The petitioner complains of illegality in the list relating to the persons below the poverty line in so far as it relates to different villages within Jandaha block, in the district of Vaishali.
Mr. Ranjan Kumar, learned AC to GA-12 in reference to an order passed by an authority enclosed at Annexure-4 submits that in so far as the complaint against respondent no. 6 is concerned, it has been examined and found to be true and

According to Mr. Shaswat Shankar, learned counsel appearing for the petitioner, there are innumerable cases of such kind where people are drawing benefit although they strictly do not come within the category of person below poverty line. Having considered the submission and bearing note of the fact that necessary action has been initiated in so far as respondent no. 6 is concerned, we allow the petitioner to establish his cause in so far as other similarly placed cases are concerned before the District Magistrate, Vaishali and who shall consider and dispose of the same in accordance with law after opportunity of hearing to the persons against whom such complaint is made.
With the observations above, we dispose of the writ petition.
