The petitioner seeks bail in Sheohar P.S. Case No. 142/2018, registered for the offences punishable under Section 302 and 120(B) of the Indian Penal Code.

Allegation against the petitioner and other co-accused is that they took the informant's grand-son with them and after committing murder with sharp-edged weapon threw his dead-body on the road.

It has been submitted that petitioner has falsely been implicated in this case. There is no eye-witness of the occurrence and no incriminating material has been found against him. Coaccused has been granted bail by this court. Petitioner has clean antecedent. He is in custody since

It appears from the case-diary that petitioner had called deceased from his house to play cricket and was the last seen person in the company of deceased before his death and witnesses have also supported the same facts.

Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the same is rejected.

Petitioner may renew his prayer for bail after completing nine months in custody.
