CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 20-04-2018 Heard learned counsel for the petitioners and the State.
2. In terms of order dated 06.04.2018 and for reasons indicated therein, the respondent no. 4 was directed to appear today. He is present in Court and has filed show cause and also 4th supplementary counter affidavit.
3. In the show cause filed, he has tendered unconditional and unqualified apology for having wrongly mentioned in his order dated 23.03.2018, that it was made in compliance of the Court's order dated 15.03.2018, though in fact, there was no such direction. It has also been stated that the mistake has been corrected by issuing letter dated 12.04.2018, copy of which has also been brought on record.
4. Having regard to the aforesaid, accepting the apology tendered, the Court does not deem it necessary to proceed any further against the respondent no. 4. The issue stands consigned with caution to the respondent no. 4 that such conduct should not be repeated in
4/4 future.
5. Coming to the merits, the letter dated 12.04.2018 of the respondent no. 4 is self speaking with regard to the petitioners not being disturbed.
6. Accordingly, the Court does not find any occasion for adjudication. Learned counsel for the petitioners also agrees that now the Court is not required to go into the merits.
7. In view thereof, the writ petitions stand disposed off.
8. Personal appearance of the officer is also dispensed with.
