JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
The accusation against the petitioner is of abducting the minor daughter of the informant. In 164 Cr.P.C statement the victim got her age recorded as 17 years when the Court assessed as 18 years, where she stated that she was being abducted by co-accused Arjun Kumar, Nandlal Mehto, Mahesh Mahto and the petitioner but she was not sexually exploited. The victim further stated that she somehow escaped from the captivity and reached to the police station. It is submitted by learned counsel for the petitioner that 164 Cr.P.C statement of the victim suggests that victim was actually not been kidnapped.

Patna High Court Cr.Misc. No.54595 of 2015 (2) dt.02-12-2015 2/2 for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Mokama P.S. Case No. 182 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Barh, Patna. With the observations above, the application stands disposed off.
