JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 Petitioners seek bail in anticipation of their arrest in connection with Dariyapur P.S. Case No. 239 of 2018 registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

As per FIR the informant has come with a case that accused persons put pressure upon the sister of the informant and her husband for transferring the property to one Peyare Lal Singh and thereafter Peyare Lal Singh and petitioners had abducted his sister.

Submission of learned counsel for the petitioners is that except suspicion as raised in the FIR no material has come

No.44280 of 2019(2) dt.18-07-2019 2/2 during investigation and other co-accused, wife of said Peyare Lal Singh has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 12.3.2019 passed in Cr.Misc.No. 74974 of 2018. Petitioners are daughter, son-in-law and villager of Payare Lal Singh.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Saran at Chapra, in connection with Dariyapur P.S. Case No. 239 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
