The petitioner seeks bail in connection with Special Case No. 11 of 2017, arising out of Dagarua P.S. Case No. 57 of 2017 dated 06.05.2017 instituted for the offence under Section 20 of the Narcotic Drugs & Psychotropic Substances Act, 1985.
Three persons namely Md. Imtiyaz, Pranav Malakar and Shibbu Sarkar were arrested by the police and 55 packets of Ganja was recovered from the vehicle which was being driven by one of them. Co-accused Imtiyaz thereafter stated that the narcotics was brought to the place from where it was seized at the instance of the petitioner.
Learned counsel for the petitioner submits that petitioner was not arrested at the spot and his name came only
Patna High Court Cr.Misc. No.53432 of 2017 (3) dt.27-11-2017 2/2 through the statement of one of the co-accused and which statement was supported by other two accused persons. The petitioner bears clean antecedent.
Taking into account the fact that petitioner was not arrested at the spot and in the past, he has not been made accused in any case, this Court is inclined to grant bail to the petitioner.
The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, NDPS Act, Purnea in connection with Special Case No. 11 of 2017, arising out of Dagarua P.S.
