The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

Petitioner is in custody since 25.01.2018. Allegation is that strong suspicion is there against the petitioner to have committed murder of the son of the informant. Suspicion is based on the basis of material collected during investigation that cycle of the deceased was recovered from the house of the petitioner. Petitioner was seen by some of the witnesses nearby the place of occurrence. Earlier prayer was refused on 18.05.2018 vide Annexure-1. Report of the learned trial judge would reveal that recently the case has been listed for prosecution evidence.

No.64697 of 2018(5) dt.12-04-2019 2/2 Considering the material and period already undergone as well as undertaking of the petitioner that he shall fully co-operate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Manigachhi P.S. Case No. 218 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Banti/Rajan U T
