The petitioners, who are father and son amongst themselves, seek bail in anticipation of their arrest in connection with Runni Saidpur P. S. Case No. 249 of 2020, dated 11.06.2020, instituted for the offences under Sections 341, 323, 324, 307, 504, 379 and 34 of the Indian Penal Code.

The accusation against both the petitioners is of having assaulted the informant and others.

The parties are co-villagers and agnates as well. There was a dispute with respect to passage between the houses of the parties in dispute here. The injury report of the informant has been brought on record. Most of the injuries are reported to be simple except for one about which opinion has been kept reserved. However, from the dimensions of the injury, it appears that such injury could have been caused in clash between the parties but not with an intention to inflict life threatening injury. No sharp cut weapon appears to have been used.

The informant is a member of the Panchayat Samiti and the petitioners do not have good equation with the informant.

Regard being had to the afore-stated facts, the petitioners, above-named, are directed to be released on

Patna High Court CR. MISC. No.3971 of 2021(2) dt.05-08-2021 3/3 bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Runni Saidpur P. S. Case No. 249 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
