JUSTICE PARTHA SARTHY ORAL ORDER 02-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Laheri P.S. Case no. 274 of 2020 registered under sections 384, 406, 420, 467, 468, 470 and 471 of the Indian Penal Code.

As per allegation in the FIR, it is stated that on information having been received about the petitioner falsely assuring different persons of getting them employed, a raid was conducted and various articles mentioned in the FIR were recovered.

It is submitted by learned counsel for the petitioner that the FIR has been registered against the petitioner on false and concocted allegations which have not been substantiated in course of investigation. It is for this reason that from the charge

Patna High Court CR. MISC. No.40963 of 2020(2) dt.02-03-2021 2/2 sheet which has been brought on record as Annexure 2 to the petition it transpires that all the witnesses are police personnel. The petitioner is in custody since 22.7.2020, investigation in the case has concluded and he has no criminal antecedent. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Laheri P.S. Case no. 274 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Biharsharif (Nalanda).
