JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This application, for grant of anticipatory bail, arises out of Maner P.S. Case No. 620 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation as per F.I.R. is that petitioner and several other persons came variously armed and caught hold of his son and started assaulting him and also fired on him, causing his death.

Submission of learned counsel for the petitioner is that altogether eleven persons said to have fired and no specific allegation has been attributed to the petitioner and co-accused having similar allegation has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 01.04.2019 passed in Cr. Misc. No. 19513 of 2019.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -Ist Class, Danapur, Patna, in connection with Maner P.S. Case No. 620 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
