JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-11-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 28.04.2017 passed in Cr. Misc. No. 14174 of 2017, on the ground that the petitioner was given liberty to renew his prayer for bail after remaining nine months in custody and the petitioner is in custody since 13.01.2017 and has remained in custody for more than nine months.
The learned A.P.P. does not oppose prayer for bail of the petitioner in the light of the observation. In the facts and circumstances stated above, the petitioner above named, is directed to be released on bail on
Patna High Court Cr.Misc. No.53458 of 2017 (2) dt.15-11-2017 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M-VII, Bettiah, West Champaran in connection with Tr. No. 741 of 2017 arising out of Chanpatia P.S. Case No. 212 of 1997, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
