1. The Petitioner seeks quashing of the order of cognizance dated 12.10.2012 passed by the Chief Judicial Magistrate, Purnea, in K. Hat (Maranga) P.S. Case No.462 of 2012/G.R. No.2752 of 2012 on the ground that it has been instituted in continuance of the same cause of action.

2. The background facts of the case is that on 08.08.2012 one Renu Tiwary instituted a case against the Petitioner stating therein that she had assaulted her upon which K. Hat (Maranga) P.S. Case No.461 of 2012 was instituted. On the same day, the Investigating Officer of the said case instituted another case against the Petitioner stating therein that while she had gone for investigation of the earlier case once again the Petitioner created nuisance and assaulted them upon which the present case was

Patna High Court Cr.Misc. No.47046 of 2012 dt.26-02-2015 2/2 instituted.

3. Considering that the present case i.e. K. Hat (Maranga) P.S. Case No.462 of 2012 is in continuation to the earlier case i.e. K. Hat (Maranga) P.S. Case No.461of 2012, the Chief Judicial Magistrate, Purnea, is directed to amalgamate the two cases so that there is no multiplicity of the proceeding nor is any person unduly harassed.

4. With the aforesaid observation, the application stands disposed off.
