The petitioner seeks bail in connection with Lalganj P.S. Case No. 125 of 2017 dated 11.06.2017 instituted for the offences under Sections 147, 149, 448, 441, 323, 307, 302 and 504 of the Indian Penal Code.
On the day when the barat for the daughter of the petitioner had come to his house, the informant alleges that he was caught hold of by one Manoj Ram and assaulted by many others including the petitioner by means of Lathi, Danda etc. When the mother of the informant came to his rescue, it has been specifically alleged that co-accused Manoj Ram assaulted her by means of an iron rod which hit her on her head. In the course of treatment, the mother of the informant died.
Patna High Court Cr.Misc. No.50902 of 2017 (3) dt.07-12-2017 Learned counsel for the petitioner submits that he has falsely been implicated in this case and it does not appear to be probable that on the date when the barat of daughter of the petitioner had come, the petitioner would indulge in such activities. It has also been submitted that he is only alleged to have assaulted the informant. So far as the assault on mother/deceased is concerned, it is attributed specifically to one Manoj Ram. The cause of occurrence is stated to be the old dispute. The petitioner is in custody since 11.06.2017. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 125 of 2017.
