JUSTICE SANJAY PRIYA ORAL ORDER 28-11-2018 Supplementary affidavit has been filed on behalf of petitioners giving detail of cases pending against petitioners, besides the statement made in paragraph of 3 of the bail petition. Let the same be kept on record.
Heard the learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners seek bail in Manjhagarh P.S. Case No. 66/2017, instituted under Sections 147, 148, 323, 504, 506, 337 and 307 of the Indian Penal Code read with Section 27 of Arms Act.
Learned counsel for petitioners has submitted that there is case and counter case between the parties. Present case has been filed as counter blast to Manjhagarh P.S. Case No.
Patna High Court Cr.Misc. No.63814 of 2018(4) dt.28-11-2018 2/3 65/2017 against the petitioners. It has been submitted that in that case petitioners' side have also sustained injury. Injury report of petitioners' side has been annexed as Annexure-4. In the instant case it is alleged that petitioner no. 1 has caused firearm injury to the son of informant, namely, Sudhanshu Kumar Singh. Petitioner no. 2 is alleged to have caused firearm injury to informant Surender Singh and petitioner no. 3 is alleged to have caused firearm injury to another son of informant, namely, Pankaj Singh. Injury report of all the three injured is available in case dairy, wherein doctor has found simple injuries on the person of injured.
Learned counsel for the petitioners has submitted that the other accused persons with similar allegation have already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 34990/2017 dated 17.10.2017.
Petitioners are in custody since 29.08.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.,
Patna High Court Cr.Misc. No.63814 of 2018(4) dt.28-11-2018 3/3 Gopalganj in connection with Manjhagarh P.S. Case No. 66/2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
