The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 120B of the Indian Penal Code.

As per prosecution case, the allegation against the petitioner is that by producing forged B.Ed. Certificate he got appointment on the post of teacher in Utkrmit Middle School, Kathara.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence rather he has been cheated by the college along with large number of students and Government of Rajasthan has constituted an expert committee to inquire into the issue regarding issuance of fake

Patna High Court CR. MISC. No.45325 of 2023(2) dt.28-07-2023 2/2 degree and the college was also banned for further session 20152016, although the petitioner passed B.Ed. in the year 2013-14 from the Jodhpur National University when the college was running under above university. The petitioner has already been terminated from his service and he has falsely been implicated in this case. He has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 27.05.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Amarpur P.S. Case No. 370 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka.
