The petitioner apprehends her arrest in connection with Dariyapur P.S. Case No.219 of 2021 (wrongly mentioned as Dariyapur P.S. Case No.540 of 2022 in the prayer portion of the bail petition), registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner undertakes to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioner alongwith other co-accused persons assaulted the informant causing injuries to him. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.42824 of 2022(2) dt.29-11-2022 2/2 petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that no specific overt act is alleged against the petitioner. Specific allegation is against coaccused, Bindeshwar Sah and Santosh Sah. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.
Considering the fact that no specific overt act is alleged against the petitioner, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-13, Saran, Chapra in connection with Dariyapur P.S. Case No.219 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) Sanjay/- U T
