2. The petitioner has preferred this application for grant of regular bail in connection with Bettiah Town P.S. Case No. 426 of 2021 dated 21.07.2021 registered for the offences punishable u/ss 341, 323, 324, 379, 307, 504 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, on 20.07.2024, the informant went to the shop of one Ravindra Rai for the purpose of recovering the outstanding loan amount then the petitioner and the two other staff members of Ravindra Rai started abusing the informant. Subsequently, all the accused persons caught hold of the informant and the petitioner inflicted several knife blow

No.47969 of 2025(2) dt.18-08-2025 2/3 on the back of the informant with the intention to kill him due to which the blood started oozing out and the informant fell down on the ground. Thereafter, the petitioner and the co-accused person snatched Rs. 1,50,000/- from the pocket of the informant. It is further alleged that the informant managed to escape with the help of local residents who also rushed him to the hospital for medical treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the informant pushed the petitioner's father which led to a sudden and unplanned scuffle. The petitioner acted out of provocation and only tried to protect his mother and other family members. The petitioner had no intention to cause serious injury or to commit any robbery. As per the medical report of the injured, he sustained three injuries in which two injuries are simple in nature and one injury is stated to be grievous in nature. Learned counsel has further submitted that the allegation of snatching against the petitioner is ornamental. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 18.02.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No. 426 of 2021 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
