The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,307,504 and 506/34 of the Indian Penal Code. The prosecution case is that the accused persons assaulted the son of the informant indiscriminately and snatched ATM card and cash of rupees twenty thousand.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. Though the injury has been found to be grievous but for the occurrence of

Patna High Court Cr.Misc. No.55509 of 2015 (2) dt.16-12-2015 2/2 25.4.2014 the FIR was registered on 29.4.2014. It is further submitted that other accused persons have been granted regular bail.

Considering the accusation being omnibus and general and the retracted version of the informant, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Katihar (Sahayak) P.S. Case No. 234 of 2014 pending in the court of learned CJM, Katihar. This application is disposed of with the aforesaid observation/direction.
