JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 409/420 of the Indian Penal Code.
At the very outset, it has been submitted by learned counsel for the petitioner that the amount in question which is Rs. 43,39,782/24, the petitioner is ready to pay full amount but as the amount is huge, he may be allowed to pay the same in installments and a reasonable time may be allowed.
Patna High Court Cr.Misc. No.51722 of 2016 (3) dt.11-01-2017 2/3 Learned counsel appearing on behalf of the B.S.F.C. does not raise any objection to the said prayer. However, he has submitted that some condition may be imposed on the petitioner for payment of the aforesaid amount within a reasonable period. Considering the facts and circumstances of the case and as the petitioner is ready to pay the whole amount but prayed that he may be allowed to pay the same in installments, hence let petitioner surrender before the Court below within a period of four weeks from today and the Court below shall release the petitioner on provisional bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction learned C.J.M., Muzaffarpur in connection with Meenapur P.S. Case No.
241 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
Patna High Court Cr.Misc. No.51722 of 2016 (3) dt.11-01-2017 3/3 cancelled by the Court below. Further once the whole amount as alleged is paid, on being satisfied with the same, the Court below shall confirm the provisional bail granted to the petitioner. .
