The present writ petition has been filed for the following reliefs :- For a direction to set aside the order of Director, Administration cum Additional Secretary, Education Department, Bihar, Patna dated 15.03.2019 (Annexure-9) by which the prayer of payment of subsistence allowance of petitioner from 14.07.2017 to 12.04.2018 has been rejected on the ground of not making attendance during the said period. It is further prayed to direct the respondents to pay the subsistence

Patna High Court CWJC No.12880 of 2019(4) dt.13-01-2021 2/2 allowance of petitioner from 14.07.2017 to 12.04.2018 and for grant of all consequential benefits.

Learned counsel for the petitioner, after some arguments, submits that he may be given liberty to file detailed representation before the respondent no.3.

In the aforesaid circumstances, the writ petition is disposed of with liberty to the petitioner to file a detailed representation before the respondent no.3 within a period of two weeks along with copy of the relevant documents and judgment/ order. If such representation is filed, in support of the claim, the above respondent shall consider the claim of the petitioner as raised in the representation in accordance with law expeditiously, preferably within a period of 45 days. It is made clear that respondent no.3 would be solely responsible for non-compliance of this Court's order within the stipulated period as aforesaid.
