Mr. Sharwan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 15-07-2025 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Chandradeep P.S. Case No. 08 of 2025, Sl. No. 248 of 2025 dated 26.01.2025 registered for the offences punishable u/ss 308(5), 308(4), 329(3), 109 read with section 3(5) of the BNS and section 27 of the Arms Act.

As per the prosecution case, it is alleged that the petitioner and other co-accused person were demanding extortion amount and the co-accused made call from Mobile No. 8294119137 to the informant and demanded Rs. 2 lakhs as an extortion amount upon which the informant replied his incapability then the co-accused Manjeet threatened to kill him.

Patna High Court CR. MISC. No.42799 of 2025(2) dt.15-07-2025 2/3 It is further alleged that on 26.01.2025, the petitioner and the coaccused persons came to the shop of the informant and one of the co-accused Ramu open fired on the staff, however, the bullet could not hit anyone.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of firing is against the coaccused Ramu. Nothing has been recovered from the conscious possession of the petitioner. The allegation against the petitioner is only of demanding Rangdari. The petitioner has six criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 20.02.2025.

5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Chandradeep P.S. Case No. 08 of 2025, Sl. No. 248 of 2025, with the following condition/s:-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
