The petitioner is in custody since 05.08.2017 in connection with Mohania P.S. Case No. 581 of 2016 for the offence registered under Sections 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the present petitioner is not named in the first information report but subsequently, on the basis of statement of two witnesses that they had seen the petitioner near the place of occurrence, the petitioner is being prosecuted in the present case. It is further submitted that no T.I. Parade has been conducted till date and there is no recovery from the conscious possession of the petitioner. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.58811 of 2017 (2) dt.14-12-2017 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. Case No. 581 of 2016 corresponding to G.R. No. 3150 of 2016.
