The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 354B and 509 of the Indian Penal Code read with Section 8 of the Protection of Children from Sexual Offenses Act, 2012. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 27.03.2021 at about 08:00 p.m. while she was returning to her house from the shop the petitioner intercepted her and allegedly snatched her scarf and after that touched her inappropriately as detailed in the FIR and even dragged her on the street. Further, on alarm, the mother of the informant came at the place of occurrence on account of which the petitioner fled away from the place of occurrence.
Patna High Court CR. MISC. No.53364 of 2021(3) dt.04-07-2022 2/2 Learned counsel raises a very short submission and submits that the date of occurrence is 27.03.2021 and the FIR has been instituted on 15.07.2021 i.e. after delay of merely four months without any plausible explanation.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the inordinate delay in instituting the FIR, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Special Case No. 48 of 2021 arising out of Jehanabad (Karauna) P.S. Case No. 443 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
