The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.
The accusation is of killing the daughter of the informant, who was pursuing her studies since last 12 years at the house of maternal father, but her dead body was recovered from the railway track.
It is submitted by the learned counsel for the petitioner that the petitioner happens to be the maternal brother-in-law of the victim and only on suspicion the accusation has been levelled. On the date of recovery of the dead body, U.D. case was registered but on the ninth day of the recovery of the dead body, the present First Information Report
Patna High Court Cr.Misc. No.54848 of 2015 (2) dt.04-12-2015 was registered. It is further submitted that co-accused Nanki Devi has been granted anticipatory bail vide Cr. Misc. No. 44751 of 2015, whereas Sanjay Kumar Singh @ Sanjay Kumar and others have been granted anticipatory bail vide Cr. Misc. No. 46132 of 2015 by Co-ordinate Bench of this Court. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the above suspicious nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachiya, Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No. 201 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
