ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the purchaser of the land which was the subject matter of civil dispute, is apprehending his arrest in connection with Buxar Town P.S. Case No.33 of 2014 for allegedly having committed the offence under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not aware that the property in question was subject-matter of civil dispute. The moment he came to know about the same, the petitioner refused to keep the land and had taken back the consideration amount. Therefore, the petitioner

It is submitted that other co-accused persons have since been extended the privilege of anticipatory bail by this Court in Cr.Misc. No.33715 of 2015, vide order dated 13.8.2015. Considering the nature of allegations and the present facts and circumstances, which have emerged and because the petitioner is not having any criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Buxar Town P.S. Case No.33 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
