The petitioners apprehend their arrest in connection with Haspura P.S. Case No. 189 of 2016, registered under Sections 429 and 295(A)/34 of the Indian Penal Code, Section 4/4(2) of Bihar Prevention of Improvement of Animals Act, 1955, Section 38(3) Prevention of Cruelty to Animals Act, 1960 and Section 43(1)(2)(3), 48 and 49 (1)(2) of Transportation of Cattle Act, 1998. The accusation is that on search of one truck beef and flesh in huge quantity was recovered. At that time, one person was apprehended, who disclosed his name as Juman Quraishi. Learned counsel for the petitioners submits that it would be appeared from the F.I.R. that one Juman Quraishi was apprehended
Patna High Court Cr.Misc. No.681 of 2017 (2) dt.17-01-2017 2/2 by the Police near the truck from which huge quantity of beef and flesh was recovered, who disclosed the name of the petitioner and others as his associates having hand in the occurrence. Further submission is that petitioner having no criminal antecedent and similarly situated co-accused Sajid Quarishi @ Md. Sajid Quaishi, Gufran Quraishi, Sherdi Quraishi and Akbar Quraishi have already been allowed anticipatory bail by a co-ordinate Bench of this Court on 20.12.2016 passed in Criminal Miscellaneous No. 51834 of 2016. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the SDJM, Daudnagar (Aurangabad) in connection with Haspura P.S. Case No.189 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
