The petitioner seeks bail in connection with Majhauliya P.S. Case No. 73/2017 dated 08.03.2017 instituted for the offences under Sections 302, 120(B)/34 of the Indian Penal and Section 27 of the Arms Act.

The informant has alleged that while he along with his brother, Sk. Anwarul (deceased) was returning from Sariswa Bazar on 07.03.2017, co-accused Sk. Bolar and Sk. Matlub confronted and fired at them. This led to injuries on the person of the brother of the informant. It is thereafter alleged that the petitioner along with others caught hold of the deceased and on the orders of the petitioner, one Sk. Buchai fired from his weapon leading to the death of the deceased.

Patna High Court Cr.Misc. No.53461 of 2017 (3) dt.29-11-2017 2/2 Learned counsel for the petitioner submits that a false case has been instituted against him and he has been made accused because of village politics.

Taking into account the fact that the petitioner is not the assailant of the deceased and that he is in custody since 30.06.2017, this Court is inclined to grant bail to him. The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S.
