ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.08.2017 in connection with Bettiah Town P.S. Case No.337 of 2017 registered for the offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has been implicated in the present case on the basis of the confessional statement made by co-accused, which has no evidentiary value.

The allegation is that the petitioner was one of the six unknown miscreants who had shot dead one criminal Babloo

Patna High Court Cr.Misc. No.59020 of 2017 (2) dt.14-12-2017 2/2 Dubey, who was an under-trial and had been produced in the Civil Court, Bettiah, which is said to be the reason behind the petitioner's implication. It is further submitted that the main accused, who is said to have fired, is one Suman Saurabh and the not the present petitioner.

Considering the fact that the co-accused Niraj Yadav, who was also similarly named by said Rana Pratap Singh, son of Rameshwar Narain Singh, has been extended the privilege of bail on 08.11.2017 in Cr.Misc. No.42721 of 2017 and the petitioner's name was also taken by the said Rana Pratap Singh, son of Rameshwar Narain Singh, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No.337 of 2017.
