The petitioner apprehends his arrest in connection with Excise Case No. 179 of 2002 registered under Section 47A of the Excise Act pending in the Court of Judicial Magistrate, 1st Class, Saran at Chapra.
The accusation is of recovery of ten litres of illicit liquor in two jerkins from the north side of the house of the petitioner.
Submission is that nothing has been recovered from the conscious possession of the petitioner.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission
Patna High Court Cr.Misc. No.705 of 2017 (3) dt.27-01-2017 2/2 that illicit liquor has been seized from the house of the petitioner. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
