The petitioner seeks bail in connection with Rail P.S. Sonepur (Hajipur) Case no. 71 of 2017 registered for the offence punishable under Section 394 of the Indian Penal Code. Four miscreants are said to have snatched the bag of the informant containing cash and other articles assaulting him by means of dagger inflicting injury in his stomach, waist and leg. Three of them were apprehended by the police while one accused managed to decamp with the booty. The blood stained dagger was recovered from the possession of the co-accused Rajesh Kumar.

Patna High Court Cr.Misc. No.53972 of 2017 (2) dt.13-11-2017 2/2 It is submitted by the learned counsel for the petitioner that the petitioner has no concern with the occurrence. As a matter of fact, the petitioner was proceeding to the house of his sister where he has been living and pursuing study as a student, in the meantime, the petitioner was apprehended by the police merely on suspicion. No incriminating article has been recovered from his conscious physical possession. The petitioner has no criminal antecedent. The petitioner has been languishing in custody since 12.08.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M (Railway) Sonepur (Saran) in connection with Rail P.S. Sonepur (Hajipur) Case no. 71 of 2017.
