Petitioner seeks bail in Muffasil P.S. Case No.399 of 2018 registered for the offence punishable under Sections 392 of the Indian Penal Code.

Informant has alleged that after collecting Rs.79,811/- he was moving towards Begusarai and in the way three unknown miscreants on motorcycle intercepted him and on strength of pistol, snatched away the aforesaid collected money as well as his personal money of Rs.4800/- and Rs.7300/- and other articles. Two miscreants were arrested on the spot by police while one managed to escape.

It has been submitted on behalf of the petitioner that the petitioner is innocent and he has falsely been implicated in

Patna High Court Cr.Misc. No.63263 of 2018(3) dt.06-12-2018 2/3 this case. It has further been submitted that nothing has been recovered from the possession of petitioner although allegation is many article and cash was looted. Petitioner is in custody since 13.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, District, Begusarai in connection with Begusarai Muffasil P.S. Case No.399 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that
