Petitioner is in custody in connection with Dhansoi P.S. Case No. 68 of 2019 for the offence under section 30(A) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner would submit that from the pickup van 1797.120 liters of foreign wine was seized. Learned counsel for the petitioner submits that petitioner was arrested on the subsequent day and nothing was recovered from the conscious possession of the petitioner. He has no concern with the pickup van or the liquor which was seized by the police.

The petitioner is in custody since 27.5.2019. Considering the fact that nothing was recovered from

No.41373 of 2019(2) dt.04-07-2019 2/2 the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IICum-Special Judge, Excise, Buxar, in connection with Dhansoi P.S. Case No. 68 of 2019.
