The petitioner seeks regular bail in connection with Birpur P.S.Case No.1 of 2018 registered for offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is that they came to the house of the informant and threatened as to why he is not vacating the house and thereafter on the order of the other co-accused persons he fired causing injury to the wife of the informant who succumbed to the injuries.

Submission of the learned counsel for the petitioner is that there is delay in lodging the FIR and further there is no eye witness of the occurrence and he is in custody since

Heard learned A.P.P. and the learned counsel for the informant, who have opposed the prayer for bail stating that petitioner is the main assailant.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.
