Mr. Arun Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-11-2018 Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Buxar (Muffasil) P.S. Case No. 87 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the allegation against this petitioner is of last seen with the deceased.

The informant has alleged in the written report that petitioner along with other accused person was seen going with the son of the informant towards Airport. It is further alleged that informant reached near the road for Airport then he found this petitioner and two other accused persons and enquired

Patna High Court Cr.Misc. No.66042 of 2018(3) dt.30-11-2018 2/2 about his son then he told that he had already left for the house. The informant got information on 24.3.2018 at about 5.30 AM that his son has been murdered. The informant has merely raised suspicion against this petitioner as last seen with his son. It has further been pointed out that other co accused of this case has already been granted regular bail by co-ordinate bench of this Court by order dated 28.8.2018 passed in Cr. Misc. no. 36165 of 2018.

Petitioner is in custody since 4.4.18 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Buxar in connection with Buxar (Muffasil) P.S. Case No. 87 of 2018, Sessions Trial no. 209/18 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
