JUSTICE RAKESH KUMAR ORAL ORDER 25-01-2017 It is a peculiar case that in a case registered under Section 304(B) and Section 34 of the Indian Penal Code in which earlier twice prayer for grant of anticipatory bail was rejected, the petitioner has again prayed for grant of anticipatory bail in Marhowrah P.S. Case No. 36 of 2013. Earlier, on the first occasion i.e. on 31.3.2014 the anticipatory bail petition of the petitioner was permitted to be withdrawn. Accordingly, it was dismissed as withdrawn. Whereas 2nd anticipatory bail petition was filed vide Cr. Misc. No. 18983 of 2014 which too was disposed of granting liberty to the petitioner to appear before the court below and make a prayer for grant of regular bail. Now after expiry of about more than two years the petitioner has again approached this court for grant of anticipatory bail.
Patna High Court Cr.Misc. No.54056 of 2016 (2) dt.25-01-2017 2/2 This is high time when this court may take serious note in the matter. The prayer for anticipatory bail again stands rejected.
While dismissing the present petition it is desirable to observe that the concerned Superintendent Of Police may examine as to under what circumstances the petitioner is at large since last several years in a case which was registered under Section 304(B) and 34 of the Indian Penal Code.
Let a copy of this order be sent to the concerned Superintendent Of Police forthwith for taking appropriate action. The petition stands dismissed.
