The petitioner seeks bail in connection with Balua Bazar P.S. Case No. 52 of 2017 dated 04.08.2017 instituted for the offence under Section 394 of the Indian Penal Code. The petitioner is not named in the F.I.R and nothing has been recovered from his possession. In fact, the motorcycle, recovered from his possession, was found to be of his cousin, who is the lawful owner of the same.
During the course of investigation, it has come to light that petitioner was on telephonic contact with other accused persons.
Taking into account the fact that petitioner does not have any criminal antecedent and he is in custody since
Patna High Court Cr.Misc. No.53496 of 2017 (3) dt.27-11-2017 2/2 07.08.2017, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul in connection with Balua Bazar P.S.
