Petitioners seek bail in K. Nagar P.S. Case No.100 of 1993 (S.T. No.253 of 2018) instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code. Counsel for the petitioners submits that there is general and omnibus allegation against the petitioners in the written report.

In the impugned order, it is mentioned that petitioners are in custody since 03.05.2018. Prayer of bail of the petitioners was rejected on the ground that they have absconded for 12 years. The case is of the year 1993 and cognizance has been taken in the year 2006.

Patna High Court Cr.Misc. No.69230 of 2018(4) dt.20-02-2019 2/2 This Court finds that petitioners have sufficiently been punished for the aforesaid latches.

In the written report, there is no specific allegation against the petitioners.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Fast Track Court No.1, Purnea, in connection with K. Nagar P.S. Case No.100 of 1993 (S.T. No.253 of 2018), subject to the condition that both the bailors shall be close relative of the petitioners. Further, (i) the petitioners will remain present on each and every date of trial, (ii) their absence on two consecutive date(s) without any reasonable cause will make their bail bonds liable to be cancelled, and (iii) the petitioners will not intimidate the witnesses in any way and will not hamper the trial.
