The petitioners seek bail in connection with Birpur P.S. Case No. 66 of 2017 registered under Sections 304(B) and 120(b) of the Indian Penal Code.

Petitioners along with other accused persons are said to have committed dowry death of the daughter of the informant. Petitioner Rani Devi is also said to have illicit extra marital affairs with the husband of the deceased. It is submitted by the learned counsel for the petitioners that the petitioners happen to be uncle-in-law and aunt-in-law of the deceased. They are living separately from the

Patna High Court Cr.Misc. No.52444 of 2017 (3) dt.12-12-2017 deceased and her husband and have no concern with their affairs. Allegation levelled against the petitioners is not specific rather omnibus. Mother-in-law of the deceased has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 21.09.2017 passed in Cr. Misc. no. 45428 of 2017. Petitioner no. 1 Gangadhar Jha has been languishing in custody since 09.05.2017 while petitioner no. 2 Rani Devi has been languishing in custody since 01.08.2017.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul in connection with Birpur P.S. Case No. 66 of 2017.
