JUSTICE SANJAY PRIYA ORAL ORDER 3/ 07-12-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in N. H. Bangra P.S. Case No.33 of 2018 instituted for the offence under Section(s) 363, 366-A/34 Indian Penal Code.
It is alleged that minor daughter of the informant had gone to the house of her neighbor on 22.04.2018 at 9.00 PM, but she did not return. The informant learnt during search that Santosh Kumar Sah has kidnapped his minor daughter with intention to marry her.
Counsel for the petitioner submits that this petitioner is sister of Santosh Kumar Sah. He has been named only on suspicion being sister of Santosh Kumar Sah.
Patna High Court Cr.Misc. No.67502 of 2018(3) dt.07-12-2018 2/2 Counsel for the petitioner further submits that another sister, Lalita Devi, has already been granted regular bail by coordinate Bench of this Court by order dated 08.10.2018 passed in Cr. Misc. No.58080 of 2018.
Counsel for the informant has appeared and opposed the prayer for bail.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, III, Samastipur, in connection with N. H. Bangra P.S. Case No.33 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
