A supplementary affidavit is filed by the petitioner. The petitioner is cited as accused in Lalganj P.S. Case No. 208 of 2016, registered under Section 414 of the Indian Penal Code and Section 11(3) of the Animal Cruelty Act.

The allegation is that eight calves were found in a vehicle and were being carried away. The petitioner being the owner of the vehicle is suspected as an accused. It is stated with reference to paragraph 31 of the case diary as well as the statement made in the supplementary affidavit that the calves were actually purchased by Md. Wakil. The petitioner being

Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 208 of 2016 subject to the following conditions:

(i) One of the bailors shall be own/close family members of the petitioner;

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the court below. In case of default in doing so on two consecutives occasions without any cogent / satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
